Longtime Christian metal band Demon Hunter have filed a trademark infringement lawsuit against Netflix, Netflix Studios, and concert promoter AEG Presents over KPop Demon Hunters.
Demon Hunter are targeting the upcoming arena concert tour inspired by the mega-popular animated film, as well as the soundtrack and the merch tied to the movie.
According to Complex, the lawsuit, filed by Demon Hunter’s corporation Hyde Lane, alleges that the similarities in name have already caused confusion among consumers. The suit cites one family who requested a refund after mistakenly purchasing $500 worth of tickets to the band’s concert, thinking they were taking their five-year-old and six-year-old girls to a show related to KPop Demon Hunters.
The person asked, “Is their [sic] anyway to refund me or get me a credit or something[?] If I dont get it refunded I will not be able to purchase tickets to the actual ‘K pop demon hunters show’.
The lawsuit also calls out “massive companies that jealously guard and enforce their own intellectual property rights willfully disregarding the rights of others in pursuit of profits.”
The band is asking for a jury trial to restore its “rightful interests” in the Demon Hunter trademark, along with seeking monetary restitution. Additionally, Demon Hunter are demanding that Netflix be prevented from using the KPop Demon Hunters name.
